Please read these terms carefully before using our website or purchasing our services.

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and 3 Delta LLC, doing business as 3 Delta Defense ("3 Delta Defense," "we," "us," or "our"), a Utah limited liability company.

By accessing or using our website at www.3deltadefense.com (the "Site"), creating an account, purchasing courses, enrolling in training, or purchasing any products, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately cease using the Site and our services.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2. Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict or inhibit their use of the Site. Prohibited conduct includes but is not limited to:

- Using the Site to transmit any unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable content - Attempting to gain unauthorized access to any portion of the Site or any systems or networks connected to the Site - Scraping, harvesting, or collecting information from the Site without our express written consent - Using any automated means, including bots or crawlers, to access or interact with the Site - Impersonating any person or entity or misrepresenting your affiliation with any person or entity - Uploading or transmitting viruses or any other malicious code - Engaging in any conduct that could damage, disable, or impair the Site or servers

We reserve the right to terminate your access to the Site at any time, without notice, for conduct that we determine, in our sole discretion, violates these Terms or is otherwise harmful to other users, us, or third parties.

3. Accounts and Membership

Certain areas of the Site, including members-only content, require you to create an account. When creating an account, you agree to:

- Provide accurate, current, and complete information - Maintain and promptly update your account information to keep it accurate and complete - Keep your password confidential and not share it with any third party - Notify us immediately at Patrick@3deltadefense.com if you suspect unauthorized use of your account - Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate your account at any time if we determine, in our sole discretion, that you have violated these Terms, provided false information, or engaged in conduct harmful to 3 Delta Defense, other users, or third parties.

Access to members-only content is granted solely to the individual account holder and may not be shared, transferred, or resold. Sharing account credentials is a material breach of these Terms and may result in immediate account termination without refund.

4. Course Enrollments and Payments

By enrolling in any course or training offered by 3 Delta Defense, you agree to the following:

a) Pricing and Payment All prices are listed in U.S. dollars. Payment is due in full at the time of enrollment. We accept payment through our secure third-party payment processors (Stripe and/or PayPal). By providing payment information, you represent and warrant that you are authorized to use the payment method provided.

b) Cancellation and Rescheduling Policy All course enrollment fees are non-refundable. No cash refunds will be issued under any circumstances, including but not limited to personal scheduling conflicts, illness, change of mind, or failure to attend.

If you are unable to attend a scheduled course, you may request a credit toward a future course or reschedule to another available date, subject to the following conditions: - Rescheduling requests must be submitted at least 72 hours prior to the scheduled course start time - Credits are valid for 12 months from the date of original enrollment and may not be transferred to another person - Rescheduling is subject to course availability and is not guaranteed - Requests submitted less than 72 hours before the course start time will forfeit all enrollment fees and credits

c) Course Cancellation by 3 Delta Defense In the event that 3 Delta Defense cancels a scheduled course, enrolled students will be offered the choice of a full credit toward a future course or a full cash refund. We are not responsible for any incidental costs you may incur as a result of a cancellation, including but not limited to travel or accommodation expenses.

d) Course Content Course content, schedules, instructors, and locations are subject to change at our discretion. We will make reasonable efforts to notify enrolled students of any material changes in advance.

5. Physical Products — All Sales Final

All sales of physical products, including but not limited to gear, merchandise, and training materials, are FINAL. We do not accept returns, issue refunds, or provide exchanges for physical products under any circumstances, except as required by applicable law.

By completing a purchase of any physical product, you acknowledge and agree that the sale is final at the time of transaction.

If you receive a product that is materially defective or damaged in transit, you must notify us within 5 business days of delivery at Patrick@3deltadefense.com with photographic evidence of the defect or damage. We will evaluate such claims on a case-by-case basis and reserve the right to determine the appropriate remedy, which may include a replacement of the same item subject to availability.

6. Firearms and Weapons Training — Assumption of Risk and Liability Disclaimer

READ THIS SECTION CAREFULLY. BY ENROLLING IN ANY COURSE OR TRAINING OFFERED BY 3 DELTA DEFENSE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

a) Assumption of Risk Firearms, weapons, and self-defense training involves inherent risks, including but not limited to physical injury, property damage, and death. You voluntarily and knowingly assume all risks associated with participation in any training course, exercise, or demonstration offered or facilitated by 3 Delta Defense, its instructors, agents, or affiliates.

b) Personal Responsibility for Skills and Knowledge All skills, tactics, techniques, and knowledge imparted through 3 Delta Defense training are provided solely for lawful self-defense and personal protection purposes. YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR HOW YOU APPLY, USE, OR FAIL TO USE ANY SKILLS, TECHNIQUES, OR KNOWLEDGE ACQUIRED THROUGH OUR TRAINING.

3 Delta Defense expressly disclaims any and all liability arising from your use or misuse of any skill, technique, tactic, or knowledge learned through our courses. This includes but is not limited to any harm caused to yourself or any third party as a result of the application or misapplication of training content.

c) Compliance with All Laws You represent and warrant that you will only apply skills and knowledge gained through 3 Delta Defense training in a manner that is fully compliant with all applicable federal, state, and local laws, including but not limited to Utah firearms laws, concealed carry laws, and use-of-force laws. It is your sole responsibility to understand the laws governing firearm ownership, carry, and use in any jurisdiction where you may apply such skills.

3 Delta Defense does not provide legal advice. Nothing in our training constitutes legal advice, and you should consult a qualified attorney for guidance on the legal use of force in your jurisdiction.

d) Fitness to Participate By enrolling in any course, you represent that you are physically and mentally fit to participate, that you are not prohibited by law from possessing or handling firearms, and that you have disclosed any physical limitations to your instructor prior to participation.

e) Release of Liability To the fullest extent permitted by applicable law, you hereby release, waive, discharge, and covenant not to sue 3 Delta LLC dba 3 Delta Defense, its owners, instructors, agents, employees, and affiliates from any and all claims, demands, damages, losses, costs, or liabilities of any kind arising out of or related to your participation in any training course or your use of any skills or knowledge gained through such training.

7. User-Generated Content

The Site may allow you to submit reviews, testimonials, and comments on blog posts (collectively, "User Content"). By submitting any User Content, you agree to the following:

a) License Grant You grant 3 Delta Defense a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, publish, translate, distribute, and display your User Content in any media, in connection with our business and marketing, without compensation to you.

b) Content Standards You represent and warrant that your User Content: - Is accurate and based on your genuine experience - Does not infringe any third-party intellectual property, privacy, or other rights - Is not defamatory, harassing, obscene, threatening, or otherwise unlawful - Does not contain advertising, spam, or solicitations - Does not contain personal information of any third party without their consent

c) Moderation We reserve the right, but not the obligation, to review, edit, or remove any User Content at our sole discretion and without notice. We are not responsible for any User Content submitted by third parties.

d) No Endorsement User Content does not represent the views or opinions of 3 Delta Defense. We do not endorse any User Content submitted by users.

8. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, course materials, videos, audio, and software, is the property of 3 Delta LLC dba 3 Delta Defense or its content suppliers and is protected by applicable United States and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site and its content for your personal, non-commercial use only. This license does not include the right to:

- Reproduce, distribute, or publicly display any content from the Site - Modify or create derivative works based on Site content - Use any content for commercial purposes without our express written consent - Remove any copyright, trademark, or other proprietary notices

Course materials provided to enrolled students are licensed solely for personal use in connection with the enrolled course and may not be shared, reproduced, or distributed in any form. Unauthorized use of our intellectual property may result in termination of your account and legal action.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 3 DELTA DEFENSE EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

3 DELTA DEFENSE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTY THAT THE RESULTS OF ANY TRAINING WILL MEET YOUR EXPECTATIONS OR THAT SKILLS LEARNED WILL BE EFFECTIVE IN ANY PARTICULAR SITUATION.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 3 DELTA LLC DBA 3 DELTA DEFENSE, ITS OWNERS, INSTRUCTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, YOUR PARTICIPATION IN ANY TRAINING COURSE, OR YOUR USE OR MISUSE OF ANY SKILLS OR KNOWLEDGE ACQUIRED THROUGH OUR TRAINING, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO 3 DELTA DEFENSE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless 3 Delta LLC dba 3 Delta Defense, its owners, instructors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

- Your use of or access to the Site - Your violation of these Terms - Your violation of any applicable law or regulation - Your User Content - Your participation in any training course - Your use or misuse of any skills, techniques, or knowledge acquired through our training - Any claim by a third party arising from your conduct

We reserve the right to assume exclusive control of the defense of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any products or services provided by 3 Delta Defense shall be resolved exclusively in the state or federal courts located in the State of Utah. You hereby irrevocably consent to the personal jurisdiction of such courts and waive any objection to the laying of venue in such courts.

Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of our intellectual property rights or other proprietary rights.

Any cause of action you may have arising out of or related to these Terms or your use of the Site must be commenced within one (1) year after the cause of action accrues, otherwise such claim is permanently barred.

13. Third-Party Links and Services

The Site may contain links to third-party websites or services, including the USCCA and partner organizations. These links are provided for your convenience only. We have no control over the content, policies, or practices of third-party sites and accept no responsibility for them.

Your use of third-party sites is governed by their own terms of use and privacy policies. We encourage you to review those policies before providing any personal information to third-party sites.

14. Severability and Waiver

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of 3 Delta Defense.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Site, constitute the entire agreement between you and 3 Delta Defense with respect to your use of the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Site.

In the event of any conflict between these Terms and any other agreement you have entered into with 3 Delta Defense, these Terms shall govern with respect to your use of the Site, unless otherwise expressly agreed in writing.
